1. What to do at the scene of an accident?

Answer:

Most states require that you stop and not leave the scene after an accident. If possible, and if safe to do so, do not move your car. Protect the accident scene until investigating officers arrive.
Take safety precautions: put flares, flags, or other warning devices to warn oncoming motorists.
If someone is injured, you are required to make sure they get proper medical attention.
Obtain the name, address, phone number, driver’s license number, name of the insurance company, and policy information of other drivers(s). Make sure that the license is current and that the registration number matches the number on the license plate.
Obtain the name of the owner, if not the driver, including address, phone number, insurance company, and policy number.
If able, please get the names of passengers, including their address and phone number.
If able, please get the names of any witnesses to the accident and write them down.
Don’t rely on the police officers getting all the names down. This is one of the most common mistakes made by motorists.
Contact the state, local, or city police.
If you are injured, don’t refuse medical attention at the scene. Be aware that you may not feel the effects of an accident until sometime later because the body “numbs” after a traumatic event.

2. What to do after the accident?

Answer:

If you are injured, seek proper medical attention. Remember your health should always come first!
Notify your insurance agent and report the accident.
Take pictures of your car and the other car involved. The police report or investigation officer can tell you where the cars have been towed.
Take pictures of the location where the accident happened.
Beware of claims investigators from the other driver’s insurance company calling on the phone and asking questions or requesting telephone-recorded interviews.
Speak to a lawyer before giving any statements.
Also, beware of insurance companies who call or send you a brochure or tell you that you don’t need a lawyer – it’s against the law in many states. Statistics show that claimants who are represented receive two or three times the amount of unrepresented claimants (Source: ALLSTATE INSURANCE COMPANY TRAINING MANUAL FOR DEALING WITH UNREPRESENTED CLAIMANTS).
In many states, a driver involved in an accident must file a report with the appropriate State Registry of Motor Vehicles within a certain time frame after an accident if there are personal injuries or property damage involved.
Failure to file an accident report may result in loss of your driver’s license and/or a fine.

3. Accident tips.

DO!

Get uninjured passengers out of the vehicle and to the side of the road, safely away from the vehicle and oncoming traffic.
Call the police immediately. If a phone is not available, ask at least two people to call.
Call an ambulance if anyone is injured.
Put out reflectors at least 300 feet towards oncoming traffic.
Record the other person’s driver’s license, registration, and license plate number.
Get the names, addresses, and phone numbers of witnesses.
Make short notes about the accident.
Report the accident to your insurance agent or company within 24 hours.

DON’T!

Make any statements about the accident to anyone but the police.
Accept any informal settlements.

4. What you need to tell the police.

Answer:

If applicable, that you complained of an injury. That other persons in the car suffered injuries.
That an ambulance was called.
That the officer made note of a dollar estimate of the damages to the vehicles.
What the impact speeds were.
The length of tire skid marks on the road.
Any malfunctioning systems on the other car, such as brake lights and wipers.
The Inspection Status of the other vehicle.
The license, registration, and insurance status of the other driver.
The names of all persons in your car.
The names and addresses of all witnesses.
The road and weather conditions.
The issuance of any summons.
The condition of the other driver.
The exact location.
The position of the other vehicles.
