Personal Injury Law – Texting While Driving
When A Distracted Driver Harms You
If you recently sustained serious injuries in a car accident, you’re probably very concerned about the long-term outlook for your health. Unfortunately, injuries can be both physically and emotionally debilitating. If your accident could have been prevented, such as in texting while driving cases, the pain can be even harder to cope with.
When the cause of a car accident is negligence, you could be eligible for financial compensation to cover the full extent of your crash-related expenses. A personal injury attorney can help make this happen. You shouldn’t have to pay for the negligent actions of another, and with the support of a personal injury attorney, you may not have to. Why Texting And Driving Can Be Deadly
Texting while driving is distracted driving and, in 32 states, counts as illegal reckless driving. In general, it is against the law to use a mobile device non-hands-free while operating a motor vehicle in Texas. This means you cannot talk, text, read and send emails, check your Facebook status, or do other things on your smartphone or tablet while driving. While you can still talk on your phone non-hands-free while driving, there are many cities and other places in Texas where this has been made illegal. It is better to avoid talking on the phone unless it is hands-free.
Despite these precautions, texting while driving is still causing accidents throughout the country. In fact, according to the National Highway Traffic Safety Administration (NHTSA), texting while driving increases the likelihood of an accident by up to 23 times. Texting behind the wheel is seen as more dangerous than talking on a cellphone as, according to NHTSA, it diverts a driver’s attention from the road in three ways:
Manual functioning, due to a driver taking at least one hand off the wheel
Visual functioning, due to a driver taking his or her eyes off the road
Cognitive functioning, due to a driver’s focus being diminished
While considered the most dangerous form, texting behind the wheel isn’t the only example of distracted driving. Any of the following actions on the road could cause an accident:
Using a GPS system
Checking a smartphone
Turning the radio
Looking at a map
Applying makeup
Searching the glove box
Eating and drinking
Even diverting attention from the road for only a few seconds can be deadly. In a study, the U.S. Department of Transportation found that “sending or receiving a text takes a driver’s eyes from the road for an average of 4.6 seconds, the equivalent — at 55 mph — of driving the length of an entire football field, blind.”
Clearly, texting while driving or any other form of distracted driving endangers others on the road. If your accident was caused by such an action, you have the right to take legal action.
Helping Victims Recover Today
Distracted drivers should be held accountable for their careless actions. An experienced attorney can help you do this through the personal injury process. By carefully gathering evidence and listening to you to fully understand how the crash impacted you and your loved ones, an attorney can create a case truly reflective of the harm you have experienced.
